Excess data charge
 
I have an account with 2 phones on - mine & my daughters.


It appears my daughter has gone wildly over her 40gb limit (for the 1st time) - and i now have a bill for £99 as opposed to £33 for the 2 phones (both Sim only).



My objection is that I (as account holder) have not been notified, so could have taken steps (like adding in Cap, they were not there when we took out the account.) My daughter says she was not told about them, but i cant verify that.


Customer services less than helpful, and am awaiting a call back in 3 to 5 days.


My question is - can Virgin have the right to debit me for the excess charge without having notified me? I also feel the rate of charge (£3 per gb as opposed to approx 50p per gb) is excessive, and in any other industry would be outlawed, but that is an Ofcom action. While they can, i am sure all mobile companies do it.


I do intend to go to Ofcom as part of the process, as i believe morally (although prob within T&Cs) no company can charge x4.5 of a fee without notifying the account holder (and it is me who has the legal contract with them,m not my daughter).


Would appreciate thoughts.....

You might have a problem, as your daughter would have received an SMS message letting her know she was getting near her data limit - VM are probably covered because of this; and, as you say, the cost of excess data is clearly defined in the T&Cs.
